A wrongful death claim allows families to recover damages when a loved one dies due to negligence. Common recoverable costs include funeral and burial expenses and medical bills related to the final injury. Families may also seek compensation for the deceased’s lost income, benefits, and household services. Emotional losses like companionship, care, and guidance are also considered.
In some cases, courts allow compensation for the emotional suffering of surviving family members. If the deceased experienced pain before death, a survival action may apply. Punitive damages may be awarded when misconduct was intentional or reckless. Each damage type requires proper documentation and legal understanding. For this purpose, you can get help from a wrongful death lawyer to handle everything with care and professionalism.
Damages Recovered in a Wrongful Death Case
Losing a loved one due to another party’s negligence is devastating, both emotionally and financially. While no amount of compensation can make up for that loss, the law allows surviving family members to pursue a wrongful death claim to recover damages. These damages aim to reduce the financial burden that often follows an unexpected death. Below is a breakdown of the types of damages commonly awarded in wrongful death cases.
1: Funeral and Burial Expenses
Funeral and burial costs are often immediate and significant. These may include casket expenses, burial plot fees, cremation, transportation, and funeral services. A wrongful death claim can help recover these out-of-pocket costs, especially when the death was sudden and unplanned. Courts view these expenses as measurable and necessary, making them among the most straightforward to recover.
2: Medical Bills Related to the Final Injury or Illness
If the deceased received medical treatment before passing away, those costs may be included in the claim. These expenses include emergency care, surgeries, hospital stays, medication, and more. Documenting all related treatments to ensure full recovery of these losses is important. Surviving family members often face substantial debt from these bills, for which the responsible party should be held accountable.
3: Loss of Income and Financial Support
One of the largest and most impactful damages is the loss of the deceased’s income. This applies if the person contributed significantly to household finances or provided long-term financial support. Courts may calculate this loss based on the individual’s age, occupation, earning potential, and remaining working years.
This category may also cover lost benefits such as health insurance, pensions, and retirement contributions. The wrongful death attorney often consults a financial expert to estimate the future earnings the family will no longer receive.
4: Loss of Services and Contributions
Beyond direct financial support, the deceased may have contributed to the household in non-economic ways. These include childcare, housekeeping, home maintenance, and transportation.
When these services are lost, surviving family members may need to hire help, resulting in measurable costs. Courts consider these indirect contributions a recoverable form of loss in wrongful death claims.
5: Loss of Companionship, Care, and Guidance
Surviving spouses, children, and sometimes parents may be entitled to damages for loss of emotional support. This includes loss of love, companionship, guidance, moral support, and affection.
While these are considered “non-economic” damages, meaning they are not tied to a direct monetary value, they carry great emotional weight. Courts consider the relationship between the survivor and the deceased when assessing the impact.
6: Pain and Suffering of the Surviving Family Members
Although not available in every state, some jurisdictions allow surviving family members to recover for their emotional distress and suffering. This applies especially when the death was traumatic, sudden, or involved witnessing the event. The impact of the loss on the mental health of spouses, children, or parents may be considered in calculating these damages.
7: Pain and Suffering of the Deceased (Survival Action)
In some cases, the estate may bring a survival action on behalf of the deceased. This is separate from the wrongful death claim and covers damages the deceased suffered between the time of injury and death. It includes conscious pain, emotional suffering, or fear of impending death. If the person did not die instantly, this type of claim may apply.
8: Punitive Damages (In Limited Cases)
Punitive damages are not meant to compensate the family, but to punish the wrongdoer for egregious conduct. These are only awarded in gross negligence, recklessness, or intentional harm cases. Courts may grant punitive damages to deter similar behavior by others in the future. Not all wrongful death cases qualify for this category.
Conclusion
Damages in a wrongful death case may cover both financial and emotional losses. Families can recover funeral costs, final medical expenses, and lost earnings. Compensation may also include the value of household services and lost benefits. Emotional losses, such as loss of companionship, guidance, and support, are factored into non-economic damages.
Surviving family members may also seek compensation for their pain and suffering. If the deceased endured pain before passing, a survival action may provide additional recovery. Punitive damages may apply in rare cases involving extreme negligence or intent. Navigating these claims requires thorough documentation, legal precision, and careful valuation of losses. To ensure a full and fair claim, it’s best to work with a personal injury law firm.
